So, you're saying Caldera put Unixware and Open Sewer Code in Linux? 'Kay. Novell did sell Santa Cruz the copyrights to UnixWare, they just didn't bother writing that down, anywhere. (No one ever told those people to *always* get a reciept?) Caldera's deal with SUN and Microsoft is okay, and Caldera doesn't have to pay Novell any part of it because they weren't licensing UnixWare to those companies. It's not about the contracts & rights anymore. It's about the illegal FRAUD that Darl and the Caldera/Canopy management attempted to execute. The absolute audacity of this scam is amazing. Novell's COURT FILING (caps for Biff) outlined a chain of willful deceit. Forget Biff and his nit-picking contract bullcrap, IBM will take care of that part. Focus on the scam. Who knew what? That is one hell of a damning set of counter-claims. It seems Wallace filed against the wrong crowd. How could ANY lawyer see the APA between Santa Cruz and Novell and determine that ANYTHING the SCO Group had to sell was legit? What the hell did Sun and Microsoft actually buy? If it had anything to do with licensing rights to SYSV copyrights, they HAD to know that SCO's claims were under a very heavy cloud of dispute. I am no lawyer, but it looks like Sun, Microsoft, and SCO is the group that Wallace should be suing. Enderle is always ranting about the linux loonies. Turns out the loonies are all firmly entrenched in the SCO/Microsoft/Sun camp. What a threesome, Darl, Wallace, and Merkey. Who'd a thunk it? All I can say is go get 'em, Novell! ...

They are a Linux distributor, and all the damage they claim from IBM's work on Linux used to be an advantage for their business, until they got the bright idea to pay a few millions of dollars for the ancient UNIX codebase. The Caldera Complaint alleges, inter alia, that IBM helped add SMP to Linux, thus unfairly competing with UNIX. But, a quick research of the topic shows that no, it wasn't IBM that put SMP in Linux... it was... yes, Caldera International, who donated the hardware so Alan Cox could improve that feature. You're provocative choice of title may work against you, though, since it tends to draw people into the thread, and really, you don't want them *reading* this crap, just reading the headlines. So, tell me, feeling a little desperate are you? Like the rug just been yanked out from under the whole fscking scam? What were Ralph and Darl thinking? That IBM would just pay them to shut up and go away? Can you name any other cases where someone savaged IBM's reputation in public and then got a settlement out of them? First, obviously, there's the increased possibility of legal trouble, which has already been discussed at length here, many many times. I still think he's probably going to get away scot-free. If SCO was a normal company, probably not, but the vast majority of SCO stock is held by a few big funds & institutions, and it seems very likely to me that many of them were in on the scam, and knew the whole thing was a fraud from day 1. I'd put at least Cohen, Renaissance, and Baystar in that category, at minimum. So I think they'd all prefer this stays out of court. They'll just pass the losses along to their own bagholders, and move on with zero consequences.
