First, obviously, there's the increased possibility of legal trouble, which has already been discussed at length here, many many times. I still think he's probably going to get away scot-free. If SCO was a normal company, probably not, but the vast majority of SCO stock is held by a few big funds & institutions, and it seems very likely to me that many of them were in on the scam, and knew the whole thing was a fraud from day 1. I'd put at least Cohen, Renaissance, and Baystar in that category, at minimum. So I think they'd all prefer this stays out of court. They'll just pass the losses along to their own bagholders, and move on with zero consequences. Since we haven't heard anything about the stock being delisted as of tomorrow, I assume this means they've filed an appeal with Nasdaq. I say "I assume" since the appeals process isn't public. Nasdaq's info page suggests that hearings usually take place around 45 days after an appeal is filed, so the appeal means SCO can go at least another 6 weeks or so without filing a 10-K. I expect they see this as a good thing, and they won't file a day earlier than they absolutely have to. Maybe they don't intend to ever file at all, and they're just stretching the process out so they can have one last go at scamming Nasdaq daytraders before making the jump to the pink sheets.
