I sure would if I were novl. I can't imagine a company in a stronger position to win such a lawsuit. Novl knows everything about the ATT/BSD deal. Novl can truthfully claim that they are harmed by scox's extortion scam.
My guess is: novl's suse purchase has been in the works for a long time. That may be the only reason that novl/suse hasn't filed a suit against scox already.
