Recs: 0 I'm glad the brook wells finally woke-up and gave IBM a very well deserved partial victory. And I'm glad to see scox's share price declining. But, I don't get all the "darl is getting reamed" and "scox is being slammed" bluster. To me, the sad bottom line looks like this: 1) wells does not give scox a slam-dunk victory everytime, but she does as much as she can. During the last hearing, I don't think she could have given scox a 100% victory without seriously risking an appeal from ibm. 2) Scox share price dropped to $0.56 the day darl took over - and that was on half as many shares as scox now has. Scox's market cap is still nearly 10X what is was pre-scam. 3) Darl is not hurting, neither is Yarro, and it's likely that no harm, of any kind, will come to either. At least, scox was that, at one point. Now scox may not even be that much. IBM, Novell, Red Hat, Chrysler, and AutoZone; we're not looking for a fight from scox. In each case, scox either initiated a bogus lawsuits, or brought on the lawsuits by blatant Lanham Act Violations. Nobdoy "screwed" scox. Msft just paid scox to file lawsuits in order to create a perceived legal cloud over Linux. The effectiveness of msft's little scam (to kill the competition via massive abuse of the US legal system) is debatable. I have never agreed with biff, but I used to understand what he was arguing. At least to the extent that I understood his basic premises. It seems there was a time when biff didn't flip-flop that often. Biff used to argue that novell owned the Unix copyrights, and that novell transferred those copyrights to scox. Then, on the novl board, biff argued that novl owned the copyrights, and novl still owns the copyrights. When I pointed out, to biff, that this contradicted his previous position about scox owning the copyrights. Biff claimed that scox both owned the copyrights, and did not own the copyrights. Now biff is flip-flopping again. Now biff is arguing that novl never owned the copyrights. Or is it that novl both owned them, and didn't own them? It's 07:53 here in denver. As ...

It also only makes sense that IBM would not want to allow it. The entire scox-scam is about harassing IBM into a settlement and/or making the public believe that scox, at least, might harass IBM into a settlement. Not only is the deposition itself a harassment, but it could very easily lead to more harassments, and more delays. More delays means no accountability, which means yet more harassment. For example, Sam might say something that scox will claim requires further investigation, and discovery for memos, emails, other depositons, etc. Even demanding the deposition is a small success for scox. It makes it appear that scox is actually preparing a case. And IBM fighting the deposition can be spun to look like IBM has something to hide. -------------------------...

I get the feeling that the Noordas want all discussion, and especially all investigation, of the Noorda's involvement in the scoxe-scam, to stop. The Noorda's are trying to imply that anybody who believes that the Noordas could possibly be involved, is insensitive to Val's memory. IMO: Val's death doesn't prove anything about the Noorda's involvement - one way or the other. At this point, I'm not so sure. Certainly sophisticated investors know this is penny-stock junk. The funadmentals speak for themself, no history of profitability, horrid financial fundamentals, dwindling cash, no prospects of future profitability, outragous legal expenses, no viable products, delisting and bankruptcy are nearly certain, and scoxe is facing several credible lawsuits against them. Considering all that, the share price is amazingly high. The market cap is about 10X waht the market cap was before the scam. The only thing scoxe has is a lawsuit against IBM. A private business is much less open to public s cuntiny, and is far less regulated. I think it's evident by now that canopy/scox can't unload shares at some hugely inflated price. If canopy were to wait for scox to drop to $1 a share, canopy could buy the entire thing $20MM. Not really all that much. I've seen a lot of small-caps completely crash on much less bad news - including heavily shorted small caps - with *far* better fundamentals. DYII was a small cap with great fundamentals, it went from $29 to $5, on a very minor suspected acconting discrepency. It happens all the time with small-caps. Except scox. 10-K filed late, CEO and CFO of parent company fired and sued for fraud, *horrible* fundamentals, core business never profitable, CEO caught in dozens of outlandish lies, awaiting a PSJ, and novell hearing which could complete ruin hope for future prospects, under-the-table scam deals exposed, heavily shorted, tons of bad press, clearly heading towards bankruptcy within a year.
