Everything we've seen in Darl's statements (reading between the lines) and SCO's association with BSF, indicates that Ralph & Darl were intending something like this from the get-go, and that Darl was hired specifically for that purpose.

It probably can't be *proved*, but Darl's said in interviews that his first step in coming on board was to review SCO's assets and identify unexploited, profitable opportunities. The fact that negotiations and consultation with BSF was already underway within 2 or 3 months of Darl taking over the helm at SCO, seems to indicate that Darl already knew he was going to try to "monetize" the Unix IP on arrival.

That's my take anyway. Your mileage may vary.
