I personally don't think so. Lanham is civil, I think, so scox will easily slip that noose.
The is fraud through and through. Easy to prove also with all of darl's lies. But, I fully the courts would perfer to drop the case. CEO's get special treatment.
Although I think it's extremely unlikely, IBM might be able to sue msft. Msft blantantly violated it's agreement with DOJ in order to orchestrate a scam lawsuit, and obvious attempts at fraud and extortion.
