If SCO is not putting real IP claims (tradesecret or copyright) directly against IBM then all the stuff in the link is a straight forward scam. Either the claims in the link are true, in which case IBM is a direct infringer or SCO's claims are fradulent. SCO's failure to press these claims against IBM will stop them from being able to press any such claims against others. The Goliath player is in a bind, saying nothing lets David distort, misrepresent or plain lie without challenge. Reply and the public is unlikely to believe the reply, threaten David over lies and it just gets worse. Traditionally smart Goliaths clam up and try to get the affair finished quickly (sound like anyone's dreams of a fast settlement?). The dumb ones settle even quicker after talking. But there's a third option that SCOX apparently didn't believe could work: stop being Goliath, become David or at least find a David so aligned with your cause it can fight for you. They assumed that if their own efforts to astroturf had failed, if professionals like Microsoft kept...

It also only makes sense that IBM would not want to allow it. The entire scox-scam is about harassing IBM into a settlement and/or making the public believe that scox, at least, might harass IBM into a settlement. Not only is the deposition itself a harassment, but it could very easily lead to more harassments, and more delays. More delays means no accountability, which means yet more harassment. For example, Sam might say something that scox will claim requires further investigation, and discovery for memos, emails, other depositons, etc. Even demanding the deposition is a small success for scox. It makes it appear that scox is actually preparing a case. And IBM fighting the deposition can be spun to look like IBM has something to hide. -------------------------...

At this point, I'm not so sure. Certainly sophisticated investors know this is penny-stock junk. The funadmentals speak for themself, no history of profitability, horrid financial fundamentals, dwindling cash, no prospects of future profitability, outragous legal expenses, no viable products, delisting and bankruptcy are nearly certain, and scoxe is facing several credible lawsuits against them. Considering all that, the share price is amazingly high. The market cap is about 10X waht the market cap was before the scam. The only thing scoxe has is a lawsuit against IBM.
